BG Team Led By Brian Glasser Helps Dismiss Improperly Filed Mass Tort Bankruptcy By 3M Subsidiary Aearo Technologies

In a win for injured soldiers, a federal judge on Friday dismissed the bankruptcy of 3M subsidiary Aearo Technologies, which was attempting to use its protections to permanently resolve 260,000 lawsuits alleging that 3M military earplugs caused hearing loss for veterans and U.S. service members. This new ruling upends 3M’s litigation strategy to resolve mass tort claims in bankruptcy, which would have circumvented the ability of plaintiffs to have their cases heard by a jury of their peers as guaranteed by the U.S. Constitution. Brian Glasser and Bailey & Glasser, LLP helped get this mass tort bankruptcy dismissed.

“The soldiers who used 3M earplugs deserve to the chance to hold 3M accountable before a jury of their peers,” said founding partner Brian Glasser. “3M and Aearo have no special right to put veterans in a bankruptcy box, and now can face these claims in front of juries around the nation.”

Bailey Glasser partners Brian Glasser and Cary Joshi join the Opening Arguments podcast to discuss winning a $5 million arbitration award against My Pillow founder Mike Lindell for claims related to election fraud data.

The Bailey Glasser team, Brian Glasser, Cari Joshi, and paralegal Manuel Rios in Washington, D.C., and partner Lori Bullock in Des Moines, Iowa, represented Robert Zeidman, a cyber security professional, in the arbitration.

Following the 2020 election, Lindell prominently trumpeted the false theory that the 2020 presidential election involved alleged Chinese government hacking that resulted in votes cast for Donald Trump being switched to Joe Biden. In July 2021, Mike Lindell sponsored his own so-called “Cyber Symposium”, which he said would provide an opportunity for technical experts in cyber forensics to examine and evaluate the evidence presented by Lindell.

Lindell was so confident in the validity of his so-called “evidence” that, as part of his Cyber Symposium, he held the “Prove Mike Wrong Challenge” and offered a $5 million prize to anyone who could prove the data was not valid. The Arbitration panel declared unequivocally that Zeidman proved Mike wrong and won the contest.

Bailey Glasser’s Title IX Team’s Latest Victory in SDSU Lawsuit Featured in Ms. Magazine

“SDSU has been cheating its female student-athletes out of hundreds of thousands of dollars in equal athletic financial aid each year… Now, it can be held accountable,” said Arthur Bryant, Bailey Glasser LLP partner and Title IX team leader representing the female athletes in the lawsuit against the university.

Bailey Glasser’s Title IX team’s latest victory in SDSU’s women-athletics lawsuit is featured today in the Ms. Magazine article: “Student-Athletes Can Now Sue Discriminatory Universities for Money Damages, a Victory for Title IX.”

“The class-action lawsuit alleges female student-athletes were given less scholarship support than the male athletes, received inferior treatment and benefits and were retaliated against when they protested against discrimination.” U.S. District Court Judge Todd W. Robinson’s ruling on April 13 “agreed their suit could go forward and went a step further—awarding the students the right to seek monetary damages.” Arthur Bryant is quoted stating that the ruling “is a major step forward for women and against sex discrimination at SDSU and nationwide.” Read the full article here.

“This is Not Over By a Long Shot”

“This is not over by a long shot”: Bailey Glasser founding partner Brian Glasser, one of the lead lawyers in the fight to protect plaintiffs in the J&J/LTL bankruptcy, made a statement to CBS News today rejecting what appears to be extra money found in Johnson & Johnson’s company lounge “seat cushions.” J&J, one of the world’s wealthiest companies, continues to try to abuse the bankruptcy process to deny plaintiffs injured by the company’s talc products their day in court.

Mr. Glasser’s full statement to CBS News reads:
The last time J&J tried this they told the world that $2 billion was more than enough to satisfy these claims. The $9 Billion they have offered today makes plain that the prior number was ridiculous, the prior bankruptcy filing was a scam and the entire exercise was a misuse of the bankruptcy system. The Court of Appeals agreed, and dismissed their case. An hour or so later they found $7 Billion in the company in seat cushions. But LTLs officers and directors apparently surrendered the right to get $61 Billon for this second alleged bankruptcy and for these same injuries. This is not over by a long shot. This case, too, ought to be dismissed. There is nothing that stops J&J from settling its cases outside of bankruptcy and that is what it needs to do.”

Partner Arthur Bryant Quoted in Sportico

Bailey & Glasser, LLP partner and Title IX team leader Arthur Bryant was quoted in today’s Sportico article, “SDSU’s Final Four Glory, Title IX Quandary Take Competing Courts.” The article examines the overwhelming excitement of the San Diego State men’s basketball team reaching the Final Four this year for the first time in school history, while simultaneously highlighting the contrasting experience for female athletes “on the pumpkin side of the university’s athletic fairytale.”

In early 2022, Bailey Glasser’s Title IX team representing 17 women athletes filed a sex discrimination class action lawsuit against SDSU for violating Title IX laws. The suit charges SDSU with depriving women of more than $1.2 million in “equal athletic financial aid” over the course of two academic years, depriving them of equal treatment, and retaliating against them for standing up for their rights. According to Sportico, “the men’s basketball Final Four bid has already netted SDSU an extra $500,000 in future NCAA Tournament distributions.” Yet, as Bryant points out, “SDSU is clearly treating its male athletes better than its female athletes… which violates Title IX.” Bryant adds that “SDSU’s men and women all deserve the same shot at that one shining moment.”

N.Y. Federal Judge Recommends Class Action Against Metropolitan Life Proceed

Bailey Glasser and co-counsel Robert Izard and Douglas Needham represent a pair of subclasses of Metropolitan Life Insurance Company whose pension benefits were unlawfully reduced using outdated mortality estimates. On March 20, 2023, a federal magistrate recommended that the claims proceed as a class action.
